Terms & Conditions

These Terms & Conditions, as may be amended from time to time, apply to all our services directly or indirectly (through distributors) made available online, through any mobile device, by email or by telephone. By accessing, browsing and using our website or any of our applications through whatever platform (hereinafter collectively referred to as the "website") and/or by completing a reservation, you acknowledge and agree to have read, understood and agreed to the terms and conditions set out below (including the Privacy Policy). These pages, the content and infrastructure of these pages, and the online reservation service provided on these pages and through the website are owned, operated and provided by Stopover Solutions FZC, P.O. Box 330772, Ras al Khaimah, United Arab Emirates (hereinafter collectively referred to as "stopovertrips.com”) and are provided for your personal, non-commercial use only, subject to the terms and conditions set out below.

§ 1 Scope of our Service
Through the website stopovertips.com provide an online platform through which touristic services (for example excursions, transfers, tickets for events and others, collectively the "services") can be booked by visitors (“customer (s)”) of the website. By making a reservation through stopovertrips.com, the customer enters into a direct (legally binding) contractual relationship with stopovertrips.com. The booked services are not performed by stopovertrips.com itself, but are only third-party services that are solely intermediated through stopovertrips.com. Solely the supplier is responsible for the performance of the services offered. stopovertrips.com has no influence on the contextual presentation or the performance of service offered by the supplier. Therefore, a claim against the performance of services booked only exists towards the third party supplier; not towards stopovertrips.com.
The supplier can link the performance of his service to specific conditions (e.g. height, weight, health, etc.). These conditions are listed and defined in the Special Conditions and in the descriptions of the tours (in the column “Good to know”). In individual cases, this can mean that a service is not available for every potential customer.
Although stopovertrips.com will use reasonable skill and care in performing offered services stopovertrips.com cannot guarantee that, all information is accurate, complete or correct, nor can stopovertrips.com be held responsible for any errors (including manifest and typographical errors), any interruptions (whether due to any (temporary and/or partial) breakdown, repair, upgrade or maintenance of our website or otherwise), inaccurate, misleading or untrue information or non-delivery of information. Obvious errors and mistakes (including misprints) are not binding.
stopovertrips.com will NOT deal or provide any services or products to any of OFAC (Office of Foreign Assets Control) sanctions countries in accordance with the law of UAE.

§ 2 Booking process
The individual services, which are listed on the website, do not represent a binding offer. The customer chooses one of the services, chooses day and time for the service, clicks on „book“-button, enters his contact details and clicks on the button „confirm booking“. With this, he makes a binding offer to stopovertrips.com.
If the selected service is available on the selected day, stopovertrips.com confirms the conclusion of the contract to the customer immediately. The acceptance of the offer by stopovertrips.com takes place under the condition that the given contact details of the customer are correct and complete and that the service booked is paid before prior to implementation. Thus, a binding contract between the customer and stopovertrips.com is concluded.
In some cases, the availability of services needs to be checked first and thus the service booked must be reconfirmed by stopovertrips.com. The contract comes into effect only when the reservation is reconfirmed by stopovertrips.com. Following the conclusion of the contract stopovertrips.com sends a booking confirmation to the customer. The obligation of the customer is to check this confirmation carefully and in case of any discrepancy to get immediately in contact (email to: info@stopovertrips.com ) with stopovertrips.com.

§ 3 Payment process & rates
Payment will be made during the booking process. The customer can choose from several payment options such as credit card, PayPal or bank transfer. The customer chooses one of the payment options and carries out the payment. Only with the credit advice of the complete payment the condition mentioned in §2 is fulfilled to conclude the contract.
If the selected service starts before the credit advice arrived at stopovertrips.com the condition mentioned in §2 is not fulfilled and the customer has no right to the service booked.
The payments made via credit card are managed by Stopover Solutions FZC. In case of a cancelation Stopover Solutions FZC grants the customer a credit advice.

Starting from 1.01.2018 the UAE has introduced 5% VAT. The VAT will be added to the rates at the end of your booking.

§ 4 Credit card payment
We accept payments online using Visa and MasterCard credit/debit card in USD. If you make a payment for our products or services on our website, the details you are asked to submit will be provided directly to our payment provider via a secured connection. The cardholder must retain a copy of transaction records and Merchant policies and rules.

§ 5 Cancellation
By making a booking with stopovertrips.com the customer accept and agree to the relevant cancellation and no-show policy of stopovertrips.com, and to any additional Special Conditions of stopovertrips.com that may apply to the booking.
A cancellation must be made in writing via e-mail. The customer may either use the cancellation system linked in the booking confirmation, or by writing an email to info@stopovertrips.com. The cancellation can be only processed if the booking confirmation number as well as the entire booking data is specified by the customer. If the cancellation is made timely the already paid fee will be returned to the customer. In other cases cancelation fees apply according cancellation policy from stopovertrips.com.
The cancellation deadlines by stopovertrips.com apply. Cancellation deadlines are counted by hours. For example, a cancellation deadline of 2 days is only met, if the customer cancels the booking not less than 48 hours before the tour start.
Unless otherwise agreed in writing, the cancellation policy of a made booking is as follows:

7 days prior to beginning of services booked 50% Cancellation fees for flight tours
25% Cancellation fees for all other services booked
Less than 48 hours prior to beginning of services booked 100% Cancellation fees for flight tours
50% Cancellation fees for all other services booked
Less than 24 hours for beginning of services booked and by no-show 100% Cancellation fee
§ 6 Refund policy
Refunds will be done only through the Original Mode of Payment.

§ 7 Minors
The customer using the website who are Minor /under the age of 18 shall not register as a User of the website and shall not transact on or use the website (Age of consent is mentioned as per the applicable law).

§ 8 Liability
stopovertrips.com is liable for the contractual breach of duty as well as for offences only in cases of intent and gross negligence. This shall not apply in case of injury of life, body and health of the customer as well as in case of claims due to the breach of cardinal obligations and the replacement of damages caused by default. As far as damages are concerned which are not the result of injury of life, body and health and if an ordinary negligence cannot be excluded, such claims shall be in lapse after one year, starting with their occurrence.
Should the price of the services offered through stopovertrips.com increase after the booking has been made and the third-party supplier request an additional payment, stopovertrips.com cannot be held liable for the additional amount. The difference has to be paid by the customer, who will also be offered to cancel the service without cancelation fees. The additional amount, unless otherwise agreed, need to be paid by the customer on site.

§ 9 Resale
Every commercial resale of the services booked through stopovertrips.com without prior permission of stopovertrips.com is forbidden. If necessary, compensation claims will arise from stopovertrips.com.

§ 10 Privacy
stopovertrips.com makes every effort to ensure the customer with a high level of service. In order to perform in line with, the necessary data is stored according to the principles of the Privacy Policy of stopovertrips.com. Accordingly the customer can demand at any time the deletion of his data unless it is required for contract execution. To demand a deletion send an email to info@stopovertrips.com.
stopovertrips.com guarantees that the data will not be disclosed to third-parties, except for the suppliers (service providers), so that they can identify and contact the customer in case of any problems.

§ 11 Court of jurisdiction
The contractual relationship between the customer and Stopover Solutions FZC is subject, regardless of the nationality of the customer, to the law of the United Arab Emirates.
Any dispute or claim arising out of or in connection with this website shall be governed and construed in accordance with the laws of the UAE. United Arab of Emirates is our country of domicile.

§ 12 Severability clause
The invalidity or unenforceability of any provisions of this Terms & Conditions shall not affect the validity or enforceability of any other provision of this Terms & Conditions, which shall remain in full force and effect. In the event of invalidity of one of the Provision of these Terms & Conditions it shall be replaced with a provision that comes close to the sense and purpose of the ineffective provision in a legally effective manner. The same applies to any loopholes.
